Terms of Service

1. Acceptance of Terms

By accessing or using the AirScales load monitoring system, mobile application, web application, hardware devices, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Beaker.ca ("Company", "we", "us", or "our").

2. Service Description

AirScales is a load monitoring system designed to assist commercial truck and trailer operators in estimating vehicle weight based on air suspension pressure readings. The Service includes:

• Hardware devices that monitor air bag pressure sensors
• Mobile and web applications for viewing weight estimates
• Cloud storage and data synchronization
• Alert and notification features

3. Important Limitations and Disclaimers

3.1 Weight Estimates Only

You acknowledge and agree that:

• Weight readings provided by AirScales are estimates and approximations
• Actual vehicle weight may differ significantly from displayed estimates
• Multiple factors affect accuracy including calibration, tire pressure, suspension condition, load distribution, terrain, and environmental conditions
• The Service is intended as a guidance tool only, not a certified weighing system
• You must use certified scales and official weigh stations to verify actual vehicle weight

3.2 No Liability for Violations or Fines

THE COMPANY IS NOT LIABLE FOR:

• Any overweight violations, citations, or fines
• Damage to vehicles, cargo, roads, or bridges due to excess weight
• Inaccurate weight estimates or system malfunctions
• Accidents, injuries, or property damage related to vehicle weight
• Loss of income, business interruption, or consequential damages
• Regulatory compliance or permit violations

3.3 User Responsibility

You are solely responsible for:

• Ensuring your vehicle complies with all applicable weight regulations
• Verifying actual weight using certified scales before operating on public roads
• Properly calibrating and maintaining the AirScales system
• Understanding and following all applicable transportation laws and regulations
• Making final decisions about vehicle loading and operation

4. User Obligations

By using the Service, you agree to:

• Provide accurate registration information
• Maintain the security of your account credentials
• Use the Service only for lawful purposes
• Not attempt to reverse engineer, hack, or compromise the system
• Not share your subscription access with unauthorized users
• Comply with all applicable laws and regulations
• Properly install and maintain hardware devices according to provided instructions

5. Subscription and Payment

5.1 Subscription Plans

Access to certain Service features requires an active paid subscription. Available plans include monthly and yearly options. New device purchases include 6 months of free subscription access for one user.

5.2 Billing

By subscribing, you authorize us to charge your payment method on a recurring basis. Subscriptions automatically renew unless cancelled before the renewal date. You are responsible for all charges incurred under your account.

5.3 Cancellation and Refunds

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No refunds are provided for partial billing periods. Access to the Service terminates immediately upon subscription expiration.

5.4 Price Changes

We reserve the right to modify subscription pricing. Price changes will be communicated at least 30 days in advance and will apply at your next renewal date.

6. Hardware Devices

6.1 Device Ownership

Purchased hardware devices are your property. You are responsible for proper installation, maintenance, and care of devices.

6.2 Warranty

Hardware devices come with a limited 1-year warranty against manufacturing defects. The warranty does not cover damage from misuse, improper installation, accidents, or normal wear and tear.

6.3 Returns

Device returns must be requested within 30 days of purchase and are subject to a restocking fee. Devices must be in original condition with all components and packaging.

7. Data Collection and Privacy

We collect and process data as described in our Privacy Policy. By using the Service, you consent to our data practices.

The Service collects vehicle weight data, location information (if enabled), device telemetry, and usage statistics. This data is used to provide and improve the Service.

8. Intellectual Property

The Service, including software, hardware designs, trademarks, logos, and content, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY DATA OR CONTENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of third parties.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service immediately ceases.

Sections that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive termination of these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction where Beaker.ca is registered, without regard to conflict of law principles.

Any disputes arising out of or related to these Terms or the Service will be resolved through binding arbitration, except that either party may seek injunctive relief in court.
